Terms of Service

These terms cover your use of the Respond desktop application, this website, and the Respond Pro subscription. By installing or using Respond you agree to them. If you do not agree, do not install or use it.
The licence you get
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Respond on computers you own or control, for your own use, whether personal or at work.
You may not:
- Copy, sell, rent, sublicense or redistribute the application.
- Reverse engineer, decompile or disassemble it, except to the extent that law expressly permits despite this restriction.
- Remove or alter any proprietary notice it contains.
- Use it to build a competing product or service.
The software is licensed, not sold. We retain all rights, title and interest in Respond, including all intellectual property in it.
The free version
The free version requires no account and has no time limit. It uses a publicly available Google translation endpoint. We do not control that service and cannot guarantee its availability, accuracy or continued existence. If it becomes unavailable, free translation may stop working until we can replace it.
Respond Pro
Respond Pro costs $9.99 USD per month and gives access to the Claude and GPT translation engines and the automatic hover preview. It renews automatically each month until cancelled.
- Billing. Payment is taken by Stripe when you subscribe and on the same day each month afterwards. Prices are in US dollars and exclude any tax that applies where you live, which is added at checkout where required.
- Cancelling. You can cancel at any time from inside the application. Access continues until the end of the period you have already paid for, and is not renewed after that.
- Failed payments. If a payment fails, access continues for a short grace period while your card is retried. If payment is not completed, the subscription lapses and the application reverts to the free version.
- Price changes. We may change the price. Existing subscribers will be told by email at least 30 days beforehand, and may cancel before it takes effect.
- Fair use. Pro includes a generous monthly character allowance intended to cover normal individual use. Sustained automated or bulk use may be rate limited or suspended.
Refunds are covered by our Refund Policy, which forms part of these terms.
Accounts
A Respond Pro subscription requires signing in with a Google account. You are responsible for keeping access to that account secure, and for activity that happens under your subscription. Tell us promptly at support@withrespond.com if you believe it has been used without your permission.
Acceptable use
You agree not to use Respond to:
- Break any law, or infringe anyone's rights.
- Read, translate or process text you are not entitled to access, including other people's private communications or credentials.
- Attempt to defeat the safeguards that stop Respond reading password fields and blocked applications.
- Overload, probe or interfere with our service, or attempt to gain unauthorised access to it.
- Resell or redistribute translation capacity obtained through your subscription.
We may suspend or terminate access for a serious or repeated breach of this section.
Translation quality
Machine translation is imperfect. Respond may produce translations that are wrong, incomplete, or that miss tone or nuance, and accuracy varies by language and engine. Do not rely on Respond alone for anything where a mistranslation would be consequential — medical, legal, financial or safety-critical matters in particular. Use a qualified human translator for those.
Third-party services
Respond depends on services operated by others, including translation providers, payment processing and hosting. Their availability is outside our control, and interruptions to them may interrupt Respond. Your use of those services through Respond is also subject to their own terms.
Updates
Respond checks for updates and may download and install them automatically to deliver fixes and improvements. We may change, add or remove features over time. If we materially reduce what a paid subscription provides, you may cancel and request a pro-rata refund of the unused part of the period you have paid for.
Disclaimer
To the maximum extent the law allows, Respond is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that it will be uninterrupted, error-free, or that translations will be accurate.
Limitation of liability
To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of Respond. Our total liability for any claim relating to Respond is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty US dollars.
Consumer rights
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that the law gives you and that cannot lawfully be excluded. In Australia, that includes rights under the Australian Consumer Law. Where such a guarantee applies and can be limited, our liability is limited to resupplying the service or paying the cost of resupply.
Termination
You may stop using Respond and uninstall it at any time. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the product. If we discontinue Respond Pro, we will refund the unused portion of any period you have paid for.
Changes to these terms
We may update these terms. The date at the top will change, and for material changes affecting subscribers we will give notice by email before they take effect. Continuing to use Respond after that means you accept the updated terms.
Governing law
These terms are governed by the laws of Australia, and the courts there have non-exclusive jurisdiction. If you are a consumer elsewhere, you keep the benefit of any mandatory protections of your own country's law.
