The terms,
nice and clear

These terms cover your use of the Respond applications for Windows and Mac, the Respond application for iPhone, this website, and the Respond Pro and Respond Max subscriptions. By installing or using Respond you agree to them. If you do not agree, do not install or use it.

They are an agreement between you and Respond alone. Apple is not a party to them and is not responsible for the application. If you bought a subscription inside the iPhone app, read Buying through the App Store as well, which sets out the parts that apply only to that purchase.

The licence you get

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Respond for your own use, whether personal or at work:

• on computers you own or control, for the Windows and Mac applications; and
• on any Apple-branded device you own or control, for the iPhone application, as permitted by the Usage Rules in Apple's App Store Terms of Service. Those rules allow use on your other Apple devices, and by members of your Family Sharing group where Family Sharing is enabled.

You may not:

• Copy, sell, rent, sublicense or redistribute the application.
• Reverse engineer, decompile or disassemble it, except to the extent that law expressly permits despite this restriction.
• Remove or alter any proprietary notice it contains.
• Use it to build a competing product or service.

The software is licensed, not sold. We retain all rights, title and interest in Respond, including all intellectual property in it.

The free version

The free version requires no account and has no time limit. It uses a publicly available Google translation endpoint. We do not control that service and cannot guarantee its availability, accuracy or continued existence. If it becomes unavailable, free translation may stop working until we can replace it.

Respond Pro and Respond Max

Respond Pro bought through this website costs $13.99 USD per month. It gives access to the Claude and GPT translation engines, the choice of a casual or formal register, and the automatic hover preview, on the Windows, Mac and iPhone apps. It renews automatically each month until cancelled.

Respond Max bought through this website costs $17.99 USD per month. It includes everything in Respond Pro, and in addition the frontier translation models in place of the standard ones, a second engine that reads back every translation as a check, and a monthly translation allowance twice as large as Pro's, on the Windows, Mac and iPhone apps. It renews automatically each month until cancelled.

Inside the iPhone app two subscriptions are sold, both through Apple, both monthly, and both renewing automatically until cancelled:

• Respond Pro, at $9.99 USD per month or the equivalent shown in your own currency. The Claude and GPT translation engines, the casual or formal register, the Respond keyboard, Learn, regional dialects, and speech recognition for the languages the iPhone cannot hear on its own.
• Respond Max, at $17.99 USD per month or the equivalent shown in your own currency. Everything in Respond Pro, and in addition the frontier translation models in place of the standard ones, a second engine that reads back every translation as a check, and a monthly translation allowance twice as large as Pro's.

A subscription bought inside the iPhone app is billed by Apple, is managed in your Apple Account rather than here, and covers the iPhone app only. A subscription bought on this website covers all three applications; a subscription bought through Apple does not unlock the Windows app or the Mac app.

Moving between the two levels is handled by Apple. Moving up takes effect immediately and Apple adjusts the charge for the remainder of the period; moving down takes effect when the period you have already paid for ends.

The following cover a subscription bought on this website. For one bought inside the iPhone app, Apple handles billing, renewal and cancellation, and Buying through the App Store sets out how.

• Billing. Payment is taken by Stripe when you subscribe and on the same day each month afterwards. Prices are in US dollars and exclude any tax that applies where you live, which is added at checkout where required.
• Cancelling. You can cancel at any time from inside the application. Access continues until the end of the period you have already paid for, and is not renewed after that. A subscription bought through Apple is cancelled in your Apple Account instead; see Buying through the App Store.
• Failed payments. If a payment fails, access continues for a short grace period while your card is retried. If payment is not completed, the subscription lapses and the application reverts to the free version.
• Price changes. We may change the price. Existing subscribers will be told by email at least 30 days beforehand, and may cancel before it takes effect.
• Fair use. Pro and Max each include a generous monthly character allowance intended to cover normal individual use, Max's being twice as large as Pro's. Reading aloud counts three characters for each character read, and each Ask Ondy question counts as at least 1,000 characters. Sustained automated or bulk use may be rate limited or suspended.

Accounts

A subscription bought on this website requires an account, which you can create by signing in with Google or with Apple, or with an email address and a password. You are responsible for keeping access to that account secure, and for activity that happens under your subscription. Tell us promptly at info@withrespond.com if you believe it has been used without your permission.

The iPhone app needs no account at all. It can be used, and Pro or Max can be bought inside it, without signing in to anything, because an App Store purchase is proved by the receipt Apple signs rather than by a login. Signing in is offered so that a subscription bought on this website is recognised on the phone, and so that your settings follow you between devices.

Acceptable use

You agree not to use Respond to:

• Break any law, or infringe anyone's rights.
• Read, translate or process text you are not entitled to access, including other people's private communications or credentials.
• Attempt to defeat the safeguards that stop Respond reading password fields and blocked applications.
• Overload, probe or interfere with our service, or attempt to gain unauthorised access to it.
• Resell or redistribute translation capacity obtained through your subscription.
• Record or transcribe people with Live translate or captions without their knowledge where the law requires their consent.

We may suspend or terminate access for a serious or repeated breach of this section.

Translation quality

Machine translation is imperfect. Respond may produce translations that are wrong, incomplete, or that miss tone or nuance, and accuracy varies by language and engine. Do not rely on Respond alone for anything where a mistranslation would be consequential — medical, legal, financial or safety-critical matters in particular. Use a qualified human translator for those.

The same goes for text Respond writes for you. Live translate types a translation of what you say into the box you chose, and suggested replies and Translate in place write text you may send. Read it before you send it: what you send is yours.

Third-party services

Respond depends on services operated by others, including translation providers, payment processing and hosting. Their availability is outside our control, and interruptions to them may interrupt Respond. Your use of those services through Respond is also subject to their own terms.

Updates

Respond checks for updates and may download and install them automatically to deliver fixes and improvements. We may change, add or remove features over time. If we materially reduce what a paid subscription provides, you may cancel and request a pro-rata refund of the unused part of the period you have paid for.

Disclaimer

To the maximum extent the law allows, Respond is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that it will be uninterrupted, error-free, or that translations will be accurate.

Limitation of liability

To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of Respond. Our total liability for any claim relating to Respond is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty US dollars.

Consumer rights

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that the law gives you and that cannot lawfully be excluded. In Australia, that includes rights under the Australian Consumer Law. Where such a guarantee applies and can be limited, our liability is limited to resupplying the service or paying the cost of resupply.

Buying through the App Store

This section applies to the Respond application for iPhone and to any subscription bought inside it. Where it differs from anything above, this section governs.

How the subscription renews

• Respond Pro is $9.99 USD per month and Respond Max is $17.99 USD per month, or the equivalent shown in your own currency. Both are monthly.
• Payment is charged to your Apple Account when you confirm the purchase.
• The subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
• You can manage the subscription, change level, or turn off auto-renewal at any time in Settings on your iPhone, under your name, then Subscriptions. Deleting the app does not cancel a subscription.
• Any unused part of a free trial, where one is offered, is forfeited when you buy a subscription.

Apple's part in this

These terms are between you and Respond only. Apple is not a party to them.

• Support. Respond is solely responsible for the application and for supporting it. Apple has no obligation to provide any maintenance or support. Write to info@withrespond.com and we will answer.
• Warranty. Respond is solely responsible for any warranty, whether express or implied by law, to the extent it is not effectively disclaimed above. If the application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the application to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever in relation to the application.
• Claims. Respond, not Apple, is responsible for addressing any claim you or a third party makes about the application or your use of it. That includes product liability claims, any claim that the application fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar law.
• Intellectual property. If a third party claims the application infringes their intellectual property, Respond, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
• Apple may enforce these terms. Apple and Apple's subsidiaries are third-party beneficiaries of these terms as they apply to your licence of the iPhone application, and on your acceptance Apple has the right, and is deemed to have accepted the right, to enforce them against you.

Where you may use it

You confirm that you are not located in a country subject to a United States Government embargo or designated as a terrorist-supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties.

You must comply with any applicable third-party terms of agreement when using the application, including the terms of your own wireless data plan.

Who we are

Respond, info@withrespond.com. Questions, complaints and claims about the application should be sent there.

Termination

You may stop using Respond and uninstall it at any time. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the product. If we discontinue Respond Pro or Respond Max, we will refund the unused portion of any period you have paid for, or where the subscription was bought through Apple, ask Apple to do so.

Changes to these terms

We may update these terms. The date at the top will change, and for material changes affecting subscribers we will give notice by email before they take effect. Continuing to use Respond after that means you accept the updated terms.

Governing law

These terms are governed by the laws of Australia, and the courts there have non-exclusive jurisdiction. If you are a consumer elsewhere, you keep the benefit of any mandatory protections of your own country's law.
